DATA RECOVERY  POLICIES , TERMS & CONDITIONS

 

PRIVACY POLICY

  Independent Technology Service Inc. (ITS - Data Recovery) respects your privacy. We do not sell, rent or loan ANY information regarding our customers to any third party. Any and all information that is submitted to us is held in strict and complete confidence.

DATA RECOVERY POLICY

 

Non-Disclosure of Customer Data:

Our commitment to protecting your privacy is taken to its furthest extreme. Your data is your most valuable possession and we treat it as if it were our own. Our labs are totally private and entered only by our staff. We further protect the privacy of your data by destroying all originals and copies within 30 days of the completion of your data recovery. Any media or equipment unclaimed after 90 days is destroyed.

Our back-ups of your data are for after-the-fact verification of the integrity of your data, for your protection, and for our own use only. We are always agreeable to signing any standard or custom-tailored Non-Disclosure Agreement you might care to furnish. Additionally, any data we collect for purposes of contacting you or your employees will not be released to any other company without your permission, including using such information for references.

TERMS & CONDITIONS:

All work order or case file authorizations (Return Material Authorization Number or RMA#) become binding agreements after the required credit card number has been furnished. We reserve the right to cancel any recovery before any fees have been collected and will return the undamaged media to you with return shipping paid by you. Cancellation by you after work has been performed or after we have received your media will incur a cancellation fee of $150.00. We accept all major credit cards. We also accept Purchase Orders on approved terms

We will do our utmost to perform within the time frame quoted, however, there are sometimes circumstances that are outside our control that could delay recovery. In these cases we will inform you of the adverse circumstances and will continue our work. After work has started, if as a result of such a delay you decide to cancel the recovery, you may be held responsible for the cancellation fee.

EVALUATION FEE, GUARANTEE, DEFINITION OF "DATA".

If we are unable to "RECOVER DATA" from your disk or other device for any reason then an explanation will be provided to you and we may at our discretion charge a $75.00 evaluation fee plus the cost to ship back your drive or other media. If you don't want the media back we will scrap it. We will scrap all customer drives or other media not claimed after 90 days

It is our policy on Data Recovery to warrant the "DATA" to be in useful condition when you receive it. "DATA" is classified as user documents, email, address lists or accounting data to name a few. It is however "NOT" Ghost Images, Backup Files, ISO Images, Zipp Files, Executable Files or any user Operating Systems or program. It is only user data that was generated by an Application Program. If you don't get the data you need you may be entitled to a refund or house credit. If you get some of your data you may be entitled to a partial refund. Any request for full or partial refund must be sent to ITS - Data Recovery in writing within the first 30 days after you receive your data. Again this does not include any programs or operating systems.

Drives still under factory warranty will not be voided by the recovery process. ITS - Data Recovery  has been approved by all manufacturer's to open hard disk drives. We can process warranty drives with the factory for no additional cost.

OTHER POLICIES

HARD DRIVE SALES POLICY:

Your satisfaction is important to! Sales and repair of all peripheral products are warranted by I.T.S. - Data Recovery for at least 90 days, unless otherwise stated. Most "New" Hard Disk Drives also carry a Factory Warranty that ranges from one to five years. Product with Factory Warranty may be returned to I.T.S. - Data Recovery - Data Recovery for processing. The warranty begins on the date of shipment and covers defects in material and workmanship, restricted to limitations stated herein.

The Warranty is, at the discretion of I.T.S. - Data Recovery, limited to the repair or replacement of the defective product. On repaired equipment, warranty is limited to original repairs performed by I.T.S. - Data Recovery Warranty may become void in cases where the product has been modified or has become defective due to other causes beyond the control of I.T.S. - Data Recovery

SHIPPING DAMAGE:

Damage to any packaging or contents must be reported to and compensation claimed from the responsible carrier in a timely manner, usually within one week. ITS - Data Recovery cannot file a claim for shipping damages.

NON-DEFECTIVE MERCHANDISE RETURN:

If for any reason you wish to return purchased equipment, ITS - Data Recovery will be happy to refund or credit you within 30 days of date of shipment. A 15% restocking fee may apply. All sales are final after 30 days. Please be sure to obtain an RMA number before returning products.

RETURNING DEFECTIVE EQUIPMENT:

Please call our Technical Support department PRIOR to returning any products. You must obtain a Return Merchandise Authorization (RMA) number. The problem may be one which a member of our technical staff can help you resolve immediately.

When you've obtained an RMA number, please display it clearly on the outside of the shipping container. It should be returned in the original box with its packing material. Return freight must be prepaid and insured for the invoiced value. COD's will be refused. Return shipment of covered warranty repairs or replacement units will be covered by I.T.S. - Data Recovery via UPS Ground. An additional freight charge will apply for express shipment.

Your return shipment should include:

1.) Name, address & telephone number.
2.) A copy of the invoice or packing slip.
3.) Reason for return.
4.) RMA number
